Stanford Medical Student Graduate, Surgical Resident Gets Fired from Hopkins- Fair or Not ??

We should all be concerned about how this initial appearance raises lots of questions of fariness:

Serrano case deserves close attention
If the facts submitted as evidence in this case are reflective of what actually took place (“Fired doctor seeks $24M,” Aug. 26), the integrity tenets of the entire surgical training program at [Johns Hopkins Hospital] have been violated.

Although these cases are rare, they must not be ignored because the outcome will determine policies, processes and systems that will impact surgical training programs across the country.
As details become flushed out, is what Dr. [Oscar K.] Serrano did of such an egregious nature that he should be summarily fired? If this is his first offense, it certainly seems very heavy-handed and over-reacting. Was he given a chance to cure his performance deficiencies?

The apparent outstanding background of Dr. Serrano reflects the over-achieving traits that are found in most Latino medical students and physicians.

Workforce diversity studies and the under supply of Latino physicians in the United States further support the need for Latino post-graduate training residents to be valued and supported since the need is so great and the supply is so [limited].

This case needs to be brought to the attention of all key stakeholders in the field of post-graduate physician training who are impacted by decisions to terminate physician residents.

I am a resident physician currently having to fight for my job as an anesthesiologist. Although I am strong academically, I was placed on professional probation. I had complaints against me of being demanding and rude. I disagreed but not having the resources to get legal representation has hurt me. I am now facing going before the Graduate medical education: Grievance and Fair Hearing committee to try and safe my job. I am afraid it will only be a formality, if I dont have a lawyer present they will just check off the box that I got a fair hearing and move on. I feel there must be so many other hispanic physicians out there in the same situation, struggling to finish their careers. I know my situation is unfair because I witness on a daily basis what other residents and attendings get away with on a daily basis yet I am being terminated for unprofessional behavior. Can anyone recommend a lawyer in new orleans, metairie, or the surrounding area? Thanks,
You have a very difficult situation. If you are terminated this will be a life changing and career changing event. Check with the American College of Legal Medicine for their recommendations on a lawyer. Local is better since they will or hopefully will be familiar with your institution and its cultural customs.

I agree that there are other Hispanic physicians in unfortunate similar situations, we have no way of quantifying this at present.
